Legal Framework

FSSAI State License is governed by the Food Safety and Standards Act 2006 and administered by the State Food Safety Authority.

Food Safety and Standards Act 2006: Establishes the Food Safety and Standards Authority of India (FSSAI) as the apex body for food regulation. All food businesses must be registered or licensed under this Act before commencing operations.

License Category — State License: Applicable to food businesses with annual turnover between ₹12 lakh and ₹20 crore. This includes restaurants, cloud kitchens, food manufacturers, importers, exporters, and large retailers. Businesses below ₹12 lakh require only basic registration; businesses above ₹20 crore require a Central License.

Regulated by: State Food Safety Authority (designated by state government). Applications filed on the FoSCoS (Food Safety Compliance System) portal. License validity: 1 to 5 years (renewable). Penalty for operating without a license: up to ₹5 lakh under Section 63 of the Act.

Determine License Category

Classify the business type — manufacturer, restaurant, trader, importer, or exporter — to ensure the correct FSSAI license form and category is applied for.

Prepare Documents & Food Safety Plan

Compile all required documents and prepare a basic Food Safety Management Plan (FSMP) detailing hygiene practices, storage conditions, and food handling procedures.

File Application on FoSCoS Portal

Online application filed at foscos.fssai.gov.in with all documents uploaded and government fee paid.

Premises Inspection by Food Safety Officer

A designated food safety officer inspects the premises for hygiene standards, storage facilities, water source, and compliance with Schedule 4 of FSSAI regulations.

State License Issued

Upon satisfactory inspection, the State Food Safety Authority issues the FSSAI State License with validity of 1–5 years (as chosen during application).
